1. Purpose
These General Terms and Conditions of Sale (GTCS) define the rights and obligations of Pierre Lorrain – Cerky Studio (Siret: 824 627 178 00026) and its clients regarding audio mixing and mastering services, carried out either remotely via the Internet or in person at the studio.
Placing an order implies full and unconditional acceptance of these GTCS.
2. Services Offered
- Audio Mixing: processing and balancing of the client’s audio tracks.
- Audio Mastering: finalization and compliance of audio files with industry standards.
- Optional Services: additional revisions, stem mastering, alternative versions.

The client acknowledges that the final quality depends on the quality of the provided files (clean tracks, no clipping, correct format).
3. Orders
3.1. Ordering Process
- The client submits a request via the website, by email, or in person.
- A quote is sent to the client. The order is confirmed upon receipt of a 30% deposit of the total amount.
- The remaining 70% balance must be paid before delivery of the final files.
- The service starts only after acceptance of these GTCS and payment validation.
3.2. Required Files
The client must provide properly prepared tracks (WAV/AIFF format, clear naming).
Cerky Studio shall not be held responsible for poor results if the provided files are non-compliant.
4. Prices and Payment
- Prices are inclusive of all taxes (VAT not applicable – art. 293B of the French General Tax Code).
- Rates are indicated on the website or in the quote.
- Accepted payment method: bank transfer only.
- A 30% deposit is required to start the service.
- The remaining 70% balance must be paid before delivery of the final files (the deposit is not an extra cost).
Before final delivery, a listening version (demo) will be sent to the client for validation. This version is for evaluation purposes only and must not be used for commercial release or public distribution. Final delivery occurs after full payment.
In case of late payment (for professional clients), statutory penalties apply (art. L441-10 of the French Commercial Code).
5. Delivery Time
Delivery times are provided for information only and may vary depending on project complexity.
A reasonable delay does not justify order cancellation or refusal of payment.
6. Revisions
Each service includes up to 5 minor revisions.
Any additional modification will be charged extra.
7. Right of Withdrawal (for consumers – B2C)
In accordance with Article L221-18 of the French Consumer Code, the client has a 14-day withdrawal period starting from the order date, unless:
- The client expressly requests immediate execution of the service and acknowledges waiving their right of withdrawal.
- The service is fully completed before the end of this period.
A withdrawal waiver form will be provided before work begins.
8. Delivery of Final Files
Final files are delivered in WAV, MP3, or DDP format (or as agreed) via a secure download link or in person for on-site services.
9. Responsibilities
9.1. Provider’s Obligations
Cerky Studio undertakes to deliver a professional service in compliance with current audio standards, with an obligation of means and not an artistic result guarantee.
9.2. Client’s Obligations
The client guarantees:
- That they hold the rights to the provided recordings.
- That they provide compliant files.
- That they do not use the service for unlawful purposes.
10. Intellectual Property
The work remains the property of Cerky Studio until full payment is received.
Once payment is completed, the client obtains usage rights for the agreed purposes.
Cerky Studio reserves the right to mention the project as a reference (unless otherwise agreed).
11. Confidentiality
Cerky Studio commits not to share client files without consent.
The client agrees not to disclose the methods or tools used by the provider.
12. Données personnelles
Les données collectées sont nécessaires à la gestion des commandes et conformes au RGPD.
Le client dispose d’un droit d’accès, de rectification et de suppression de ses données (contact : cerky.studio@hotmail.com).
13. Force Majeure
Cerky Studio shall not be held liable for any event beyond its control (server failure, illness, natural disaster, etc.).
14. Governing Law and Disputes
These GTCS are subject to French law.
In case of a dispute, an amicable solution will be sought before any legal action.
Failing this, exclusive jurisdiction lies with the courts of the provider’s domicile (France).
