Purpose<\/h2>\n<p>These General Terms and Conditions of Sale (GTCS) define the rights and obligations of Pierre Lorrain \u2013 Cerky Studio (Siret: 824 627 178 00026) and its clients regarding audio mixing and mastering services, carried out either remotely via the Internet or in person at the studio.<br \/>\nPlacing an order implies full and unconditional acceptance of these GTCS.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>2. Services Offered<\/h2>\n<ul>\n<li><b><\/b><b>Audio Mixing<\/b>: processing and balancing of the client\u2019s audio tracks.<\/li>\n<li><b><\/b><b>Audio Mastering<\/b>: finalization and compliance of audio files with industry standards.<\/li>\n<li><b><\/b><b>Optional Services<\/b>: additional revisions, stem mastering, alternative versions.<\/li>\n<\/ul>\n<p>Service details are available on the website: <b>www.cerky-studio.com<\/b>.<br \/>\nThe client acknowledges that the final quality depends on the quality of the provided files (clean tracks, no clipping, correct format).[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>3. Orders<\/h2>\n<h3>3.1. Ordering Process<\/h3>\n<ul>\n<li>The client submits a request via the website, by email, or in person.<\/li>\n<li>A quote is sent to the client. The order is confirmed upon receipt of a <strong>50<\/strong><b>% deposit<\/b> of the total amount.<\/li>\n<li>The <b>remaining 50<\/b><b>% balance<\/b> must be paid before delivery of the final files.<\/li>\n<li>The service starts only after acceptance of these GTCS and payment validation.<\/li>\n<\/ul>\n<h3>3.2. Required Files<\/h3>\n<p>The client must provide properly prepared tracks (WAV\/AIFF format, clear naming).<br \/>\nCerky Studio shall not be held responsible for poor results if the provided files are non-compliant.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>4. Prices and Payment<\/h2>\n<ul>\n<li>Prices are inclusive of all taxes (<b>VAT not applicable \u2013 art. 293B of the French General Tax Code<\/b>).<\/li>\n<li>Rates are indicated on the website or in the quote.<\/li>\n<li>Accepted payment method: <b>bank transfer only<\/b>.<\/li>\n<li>A <b>30% deposit<\/b> is required to start the service.<\/li>\n<li>The remaining <b>70% balance<\/b> must be paid before delivery of the final files (the deposit is not an extra cost).<\/li>\n<\/ul>\n<p>Before final delivery, a <b>listening version (demo)<\/b> will be sent to the client for validation. This version is for evaluation purposes only and must not be used for commercial release or public distribution. Final delivery occurs after full payment.<\/p>\n<p>In case of late payment (for professional clients), statutory penalties apply (<b>art. L441-10 of the French Commercial Code<\/b>).[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>5. Delivery Time<\/h2>\n<p>Delivery times are provided for information only and may vary depending on project complexity.<br \/>\nA reasonable delay does not justify order cancellation or refusal of payment.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>6. Revisions<\/h2>\n<p>Each service includes <b>up to 5 minor revisions within 10 days after delivery of the first version<\/b>.<br \/>\nAny additional modification will be charged extra.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>7. Right of Withdrawal (for consumers \u2013 B2C)<\/h2>\n<p>In accordance with <b>Article L221-18 of the French Consumer Code<\/b>, the client has a 14-day withdrawal period starting from the order date, <b>unless<\/b>:<\/p>\n<ul>\n<li>The client expressly requests immediate execution of the service and acknowledges waiving their right of withdrawal.<\/li>\n<li>The service is fully completed before the end of this period.<\/li>\n<\/ul>\n<p>A <b>withdrawal waiver form<\/b> will be provided before work begins.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>8. Delivery of Final Files<\/h2>\n<p>Final files are delivered in WAV, MP3, or DDP format (or as agreed) via a secure download link or in person for on-site services.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>9. Responsibilities<\/h2>\n<h3>9.1. Provider\u2019s Obligations<\/h3>\n<p>Cerky Studio undertakes to deliver a professional service in compliance with current audio standards, with an obligation of means and not an artistic result guarantee.<\/p>\n<h3>9.2. Client\u2019s Obligations<\/h3>\n<p>The client guarantees:<\/p>\n<ul>\n<li>That they hold the rights to the provided recordings.<\/li>\n<li>That they provide compliant files.<\/li>\n<li>That they do not use the service for unlawful purposes.<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>10. Intellectual Property<\/h2>\n<p>The work remains the property of Cerky Studio until full payment is received.<br \/>\nOnce payment is completed, the client obtains usage rights for the agreed purposes.<br \/>\nCerky Studio reserves the right to mention the project as a reference (unless otherwise agreed).[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>11. Confidentiality<\/h2>\n<p>Cerky Studio commits not to share client files without consent.<br \/>\nThe client agrees not to disclose the methods or tools used by the provider.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>12. Donn\u00e9es personnelles<\/h2>\n<p>Les donn\u00e9es collect\u00e9es sont n\u00e9cessaires \u00e0 la gestion des commandes et conformes au RGPD.<br \/>\nLe client dispose d\u2019un droit d\u2019acc\u00e8s, de rectification et de suppression de ses donn\u00e9es (contact : c<b>erky.studio@hotmail.com<\/b>).[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>13. Force Majeure<\/h2>\n<p>Cerky Studio shall not be held liable for any event beyond its control (server failure, illness, natural disaster, etc.).[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space][vc_separator css=&#8221;&#8221;][vc_empty_space][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<\/p>\n<h2>14.
